Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CostNet web application available at costnet.in (the "Service"), operated by CostNet ("we", "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

CostNet provides automated cost analysis of sheet-metal parts from CAD files, plus tools for managing projects, quotes, and pricing configurations. The analysis output is provided for informational purposes only and should be independently verified before commercial use.

2. Eligibility and accounts

You must be at least eighteen (18) years old to use the Service. You are responsible for safeguarding your sign-in credentials and for all activity under your account. Notify us promptly of any unauthorised use.

3. Your content

CAD files, project data, and any other material you upload to the Service ("Your Content") remain your property. You grant us a limited, non-exclusive licence to host, process, and display Your Content solely for the purpose of providing the Service to you. We do not claim ownership of Your Content and will not use it to train models or share it with other customers.

4. Acceptable use

You agree not to:

• Upload content you do not own or have rights to use.
• Reverse-engineer, scrape, or attempt to extract source code from the Service.
• Use the Service to develop a competing product.
• Interfere with the Service's operation or attempt to gain unauthorised access to systems or other users' data.
• Use the Service in any way that violates applicable law.

5. Intellectual property

The Service, including its design, code, branding, and documentation, is owned by CostNet and protected by intellectual property laws. Nothing in these Terms transfers any of our intellectual property rights to you.

6. Disclaimer of warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the cost estimates produced by the Service are accurate, complete, or suitable for any specific commercial decision. You are solely responsible for verifying any output before relying on it.

7. Limitation of liability

To the maximum extent permitted by law, in no event will CostNet, its founders, employees, contractors, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of the Service, whether based in contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

Our total cumulative liability for any claim arising out of or in connection with these Terms or the Service is limited to the greater of (i) the amount you paid us for the Service in the twelve (12) months preceding the claim, or (ii) ₹10,000.

8. Indemnification

You agree to indemnify and hold harmless CostNet and its affiliates from any claim, demand, or expense (including reasonable legal fees) arising out of Your Content, your violation of these Terms, or your violation of applicable law or third-party rights.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service at our discretion, with or without notice, including for violation of these Terms or for prolonged inactivity. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and indemnification) survive.

10. Changes to these Terms

We may revise these Terms from time to time. We will update the "Last updated" date above. Continued use of the Service after a revision constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India.
